Half-baked study cooks margins tax

Question 3, the business margins tax, is a study in overreach. So it’s appropriate and unsurprising that the most recent and likely last pre-election study on the initiative’s economic impact holds even less water than the question itself.

What was surprising, however, was UNLV delivering exactly what the question’s supporters wanted in exchange for the commission they paid to the university: an analysis that says a huge new tax on employers will boost the economy and increase overall employment.

Every other credible study says Question 3, if approved by voters in November, will immediately give Nevada one of the least-friendly business climates in the West, reduce consumers’ disposable income and wipe out thousands of private-sector jobs. The 2 percent tax on businesses with at least $1 million in annual revenues, minus deductions for the cost of materials or labor, will turn barely profitable companies into money losers and prompt some employers to close their doors. The question isn’t whether Question 3 will blast Nevada — its mere presence on the ballot is hurting the state’s efforts to attract new industry — but how badly it will damage the state’s economy if it passes.

However, UNLV’s Center for Business and Economic Research would have everyone believe that transferring private capital to government control is the path to prosperity. The conclusions were so laughable that UNLV issued a news release discrediting the Question 3 analysis upon its release this month. Acting UNLV President Don Snyder asked the Washington-based Brookings Institution to review the study and assess its quality.

As if we need verification that it stinks.

Question 3, called The Education Initiative, was placed on the ballot by the state teachers union, which asserts that a huge infusion of money will fix Nevada’s underachieving schools. The tax could take anywhere between $460 million and $860 million per year from the state’s employers.

UNLV’s study buys into the argument that increased spending will produce better results from schools, even though there is plenty of research to the contrary. The authors use this premise to assert that the benefits of improved schools and the hiring of thousands of teachers will exceed the economic harm caused by the tax, yielding a net economic benefit.

The study ignores several economic and political realities:

1. Businesses that lack the capital to reinvest can’t grow. When government employees are hired at the expense of private-sector jobs, those government positions aren’t sustainable.

Letter: Vote ‘no’ on Education Initiative

Mr. Cooper (Letters, August 28, 2014) argues for a new business tax to fund an Education Initiative. Like many arguing for higher taxes, he assumes that government will spend the money wisely.

But facts say otherwise. A 2012 Harvard study by Hanushek, Peterson, and Woessmann was “unable to find significant evidence that increased school expenditure, by itself, makes much of a difference.”

NPRI topples 3,610 dominoes to show margin tax destruction

The Nevada Policy Research Institute recently held a demonstration for Las Vegas media to show the devastating domino effect passage of the proposed margin tax, or Question 3, will have on the Silver State’s economy, businesses and families.

According to a recent study, passage of the margin tax will mean 3,610 Nevadans will lose their jobs, destroying their means of providing for themselves and their families. NPRI hired a professional domino toppler to spell out the message “QUESTION 3 KILLS JOBS” using 3,610 individual dominoes.

Before a crowd of reporters from television and radio stations, newspapers and online publications, NPRI President Andy Matthews delivered a simple, yet eye-opening message about the tax that is being pushed almost entirely by the state teacher union.

“These jobs — of individuals and families — are not just statistics,” he said. “These are real families who will struggle to pay rent or their mortgage, or to put food on the table. Their children could well be marked forever by the family stress resulting when their moms and dads lose their jobs.”

He went on to explain that, just as he was able to topple the domino display that was eight hours in the making with a single push, so too could voters topple the lives of thousands of hard-working Nevadans with a push of a button this November.

The domino spectacle was be created by Robert “The Domino Wizard” Speca and included special effects like the Tarzan Swing, the “Bahama Tom Inverted Cascade Slide for Life” and “Up the ladder, walk the plank.” Speca originated the category of Domino Toppling in the Guinness Book of World Records and has held the World Records five times. Twenty-four mousetraps, representing the $240 million in disposable income that would be lost if the tax passes, shot dominoes into the air for the finale.

NPRI: New margin tax study seriously flawed

LAS VEGAS — Responding to today’s release of a study paid for by margin tax proponents and purporting to show that the tax would have a positive impact on Nevada’s economy, Geoffrey Lawrence, NPRI’s research director, released the following comments:

The analysis funded by the margin tax sponsors through UNLV’s Center for Business and Economic Research suffers from several major shortcomings.

First and foremost is that the economic-impact model employed by the authors fails to account for the negative impact of short-term capital consumption in the medium- to long-term. While not all details are provided, the purported job “gains” from the margin tax appear to result entirely from diverting corporate funds from capital investment toward government spending programs that are more labor-intensive.

Even the most basic economics textbooks, however, teach that capital investment is the primary determinant of growth in labor productivity, and consequently, wages. Private industry investments are the base of the economy.

The authors claim that this diversion of capital investment will result in an immediate boost to state gross domestic product, supposedly because converting these resources into wage income will accelerate cash flows and produce a “stimulus” effect.

Likewise, the benighted may grow fatter in the short term by eating their seed corn. Farmers, however, never prosper by eating their seed corn and neither can advanced economies.

Sustaining and growing Nevada’s capital supply is vital to Nevada’s long-term economic growth and increasing the earnings of private workers. Ph.D. economists should know this.

Additionally, the authors appear to intentionally mislead readers about the impact that higher spending has on public education. While the authors acknowledge the large body of academic research showing no relationship between spending levels and outcomes, they purport to represent an offsetting body of research that finds such a relationship.

The studies they cite, however, don’t actually make this comparison at all. They instead relate class size to achievement levels in the early grades — a body of research that is not in dispute.

UNLV disowns its own study on margin tax

UNLV is wringing its hands over an economic study done by its Center for Business and Economic Research.

The center released the study on Tuesday and reported that the Education Initiative, also known as the margin tax, was a way to earn the state up to $862 million for Nevada’s K-12 education system while creating more than 13,000 jobs in 2016.

The center’s report “does not represent the position or views of the university,” UNLV acting President Donald D. Snyder said in a media release on Thursday.

Commentary: ‘Education Initiative’ is really disastrous Margins Tax

A July 25 letter in the Reno Gazette-Journal from a retired Washoe County School District employee shows that the teachers’ union campaign for the margins tax on the November ballot will reach new lows of dishonesty and deception.

The deception starts with the title of ballot question 3, “The Education Initiative,” with 84 confusing sections, but only one on education. The letter by Stephen Norman of Sparks says it “was developed to provide appropriate funding for a quality education for all Nevada children.” The measure does not assure that a single new penny goes to K-12, but they gave it the “Education” title to con voters into believing it will better education.

If the proponents of the tax had any wholesome intent and intellectual competence, they would say just how much the measure will raise our taxes ($700 million a year) and how much of that will be spent on education. Instead, they hide behind bland and misleading phrases like “appropriate funding.”

Norman says, “Nevada’s education budget has been cut by $700 million since 2009!” He gives no source for this claim, but by its very terms it’s intentionally misleading. The reason is that it references budgets, which include wish lists of school districts and other tax-eaters. An explanation of the ways in which such budget figures are artificially inflated to mislead and be useless is so long that it must wait for another day.

The key facts about actual spending are these: Over the last 20 years, state general fund K-12 spending in real terms (net of inflation) per student has risen about 40 percent — faster than spending on any other major budget category. However, the per-person real incomes of Nevada families and businesses paying the taxes to support those schools rose only about 10 percent. That is, despite all the rhetoric about shorting our schools and kids, the spending has risen hugely and become an ever larger burden — by 30 percent — for beleaguered taxpayers.

In fact, total state spending in that time, driven by rapid increases in K-12 and Health and Human Services, has risen about 20 percent faster than the incomes of Nevadans. Worse, in the Great Recession and Obama’s non-recovery of the last five years, per-person real incomes of Nevadans have fallen by 10 percent while state K-12 real per-student spending has increased by that amount. The only actual spending cuts occurred after the Legislature’s blow-out when it foolishly hiked 2009 real per-student spending 19 percent.

Norman falsely claims, “Our schools spend just over $7,000 per student, whereas the national average is well over $11,000. As a result, Nevada ranks at or near the bottom on nearly measures of education quality.” In fact, for school year 2011-12 (the latest one for which complete state-by-state figures are available), Nevada revenues spent on K-12 were $9,457 per student, and that figure is now near or above $10,000. The teachers’ union likes to quote lower “current spending” figures, as if the dollars we pay to build new schools don’t really count and aren’t a burden on our families and businesses.

Margins tax considered a failure in Texas

Student Annie Healion, in her letter to editor [Voices, Aug. 2], complains of “missing covers of outdated textbooks … and countless other marks of lack of funding in Nevada schools.” She implores readers to support the Education Initiative because “the 2% corporate tax is minute compared to most other states’ margin taxes of 6, 7 and 8 percent.”

She apparently hasn’t been reading those texts because no other state except Texas has a margins tax, and its is two to four times lower than that proposed for Nevada in the special-interest ballot proposition she champions.

Locals discuss proposed margin tax

A proposed tax will cost Nevadan jobs and won’t necessarily help the schools its designed to fund, said opponents of the margin tax on Thursday.

The Elko Area Chamber of Commerce’s Government Affairs Committee organized a public forum to discuss the margin tax — also called “The Education Initiative” and “Question 3” — which would place a 2 percent tax on the gross revenue of  businesses that generate more than $1 million in annual revenue.

Voters will decide at the ballot in November whether the tax is implemented. Until then, sides arguing for and against the bill are trying to rally supporters.

The chamber invited Manny Martinez and Jerry O’Driscoll, directors of Reno-based NV Jobs PAC — a political action committee formed for the purpose of defeating the margin tax — to share their thoughts with forum attendees, an audience of about 20 people.

O’Driscoll said profit margins for many businesses, even those grossing more than $1 million, aren’t substantial. A trucking company with a fleet of five semis, he said for example, that collects $2 million might only profit $100,000 after factoring in gas, maintenance costs, employee salaries and benefits and other miscellaneous expenses.

Apply the margin tax to the calculation, and that profit drops to $72,000.

“A seemingly small tax on the gross revenue of the business translates into a very high tax on its profits,” O’Driscoll said.

In the trucking company scenario, O’Driscoll imagined the profit is split between two owners who now bring home less money than they pay their truck drivers, and they’re forced to lay off a receptionist.

The $1 million threshold of gross sales, NV Jobs PAC representatives said, is a mark many businesses hit.

If passed, money generated from the tax will go into Nevada’s distributive school account, which is dispersed to school districts.

NPRI study: Margin tax would kill 3,600+ jobs, have
domino effect on thousands of Nevada jobs and families

LAS VEGAS — Over 3,600 jobs will be lost if voters approve Question 3, commonly called the margin tax, this November, a study released today by the Nevada Policy Research Institute finds.

The new study, entitled The Fiscal and Economic Impact of Establishing a Margin Tax for Nevada, reports sophisticated econometric modeling of how the margin tax most likely would impact the Silver State economy.

Both private-sector and overall employment would be lowered by the margin tax, the model finds. Investment in Nevada would also be reduced.

Authored by Paul Bachman, Michael Head and Frank Conte of the Beacon Hill Institute at Suffolk University, the report also sees the margin tax decreasing Nevadans’ real disposable household income each year by $240 million.

EDITORIAL: Question 3 counters country’s tax-cutting trend

If Nevada were really trying to catch up to other states, if it were really serious about creating an environment for future prosperity and opportunity, then Question 3 on November’s ballot would seek to cut taxes, not raise them.

Question 3 is the 2 percent margins tax initiative placed on the ballot by the state teachers union. If voters approve the question, an estimated $750 million per year would be taken out of the recovering private sector at the expense of business job creation, just as Nevada’s economic development efforts are becoming better coordinated and more productive.

The mere prospect of such a punitive tax becoming law in Nevada puts the state at a competitive disadvantage in its pursuit of new industry and investment. Across the country, states are raising the stakes in luring companies — and fending off outsiders intent on plucking top employers — by cutting taxes.

— This month, Rhode Island’s corporate income tax rate fell from 9 percent to 7 percent.

— Also this month, Indiana’s corporate income tax rate fell from 7.5 percent to 7 percent. The rate will drop again next year, to 6.5 percent. Indiana’s personal income tax rate will fall from 3.4 percent this year to 3.23 percent in 2017, and the state abolished its inheritance tax.

— Last month, Ohio Gov. John Kasich signed into law several tax cuts, from deductions for small businesses to an income tax cut to an expansion of tax credits for low- and middle-income earners.

— Earlier this year, Wisconsin Gov. Scott Walker signed into law property tax cuts and income tax cuts.

— Last year, about 20 states enacted at least one tax cut. Nevada was one of them, approving a small-business payroll tax deduction.

Nevada’s Margin Tax Initiative to affect farmers and ranchers

As the November election approaches, so does the Education/Margin Tax Initiative on Nevada’s ballot, a measure that could greatly affect many of Nevada’s agriculturists especially farmers and ranchers in the state.

The Margin Tax Initiative or Question 3 on the upcoming ballot would require any business with gross revenues of more than $1 million to pay a margin tax liability of 2 percent on their entire revenue. The tax revenue would be spent on education in Nevada.

“It is the equivalent of a 14 to 15 percent corporate income tax rate because it’s on gross income; it’s not on net income,” said Karen Griffin, spokesperson for the Coalition to Defeat the Margin Tax Initiative. “This initiative is deeply flawed and costly.”

Griffin explained that although the additional tax revenue would supposedly go to education, the initiative provides no guidelines on how funds should be spent, giving the state the authority to divert funds to another cause.

The Coalition said that the tax initiative could raise between $460 million and $800 million annually, resulting in costly taxes for employers with incomes higher than $1 million.

According to Griffin, the additional tax would also make Nevada one of the five highest taxed states in which to operate, leading to a loss of new businesses and jobs. The Coalition estimates 9,000 jobs will be lost if the initiative passes.

Griffin also explains that the new tax would be especially detrimental to employers that have high overhead costs and small profit margins including agriculture operations, grocery stores, restaurants and other small businesses.

“This is a 2 percent tax on gross revenue and in many cases, that’s more than farmers are making,” Griffin said. “These farms have been in families for generations and now they are looking to have to give up what their families have been working on for years.”

State education tax battle to gain money through summer

Question 3 on the Nov. 4 ballot, called The Education Initiative, is arguably the most important issue for voters this election year. Although the focus is voter education, money will play an important role in the debate when the campaign intensifies this summer.

Solari: Margins tax a danger to economic development

Economic development is gaining momentum in Reno and Nevada, but a self-inflicted wound could stop the economic recovery in its tracks.

The margins tax, a proposal by the state teachers union to levy a 2 percent tax on all businesses with over $1 million in revenue, will go before voters this Nov. 4.

Nevada businesses are just coming out of a long economic downturn. Here in Reno, the region is re-inventing itself from a gambling past and moving into an entrepreneurial future. Reno has made a lot of headway, and much of it has been built on the reputation of Reno as a great place to live, work, and start and grow a business.
